An indivisible injury is when a person is injured by multiple people and it is difficult to determine which person or persons caused the injury. When this happens each wrongdoer that caused the injury can be held responsible for all the damages.
In the Landers v. East Texas Salt Water Disposal case the Texas Supreme Court said that when the acts of two or more wrongdoers produce an indivisible injury (an injury that cannot be apportioned with reasonable certainty to the individual wrongdoers) all of the wrongdoers will be held jointly and severally liable for all damages. This means the injured person can recover part or all damages from any one wrongdoer or from all wrongdoers. Under this rule one wrongdoer can be held responsible for the entire damage amount, even if others’ actions contributed to the injury. This rule protects innocent injured parties from being left uncompensated when it is impossible to determine which wrongdoer caused their injury.
