Frequently Asked Questions About Personal Injury Claims

Generally, the more serious the injury, the more you need an attorney to handle your claim. Sometimes, if you are willing to put in the time and effort on smaller claims you can do well by handling them yourself. However, in more serious injury cases, most people benefit greatly from the service of an experienced attorney.

Most people are surprised to know that a very small percentage of attorneys are board-certified.  When you hire a board-certified personal injury lawyer, you know that the lawyer has met certain standards required by the Texas State Board of Legal Specialization (TBLS). The more serious the injury, the more you need a board-certified personal injury attorney. To become a board-certified personal injury law specialist, an attorney must submit references from other attorneys (including a judge), attend extra continuing legal education classes, pass the day long board certification exam, and complete a certain number of trials in personal injury law. Only board-certified attorneys can say that they are specialists in personal injury law. For information about board certification and the TBLS, click here.

Very few personal injury cases go to trial. If the claim is handled properly by an experienced attorney, it would be very unlikely to see it go to trial. Also, your chance for a trial is smaller when the insurance company knows that you’re represented by a competent, board-certified personal injury trial specialist, who will not be intimidated in the courtroom.

This is almost an impossible question to answer for a client, at least in the first meeting. The value of the case is largely dependent of the liability of the other party and the severity of the injury, which is often not known at first glance. Properly determining and advising clients on the value of their cases can only be done by an experienced attorney.  Presenting a claim to the insurance company that will maximize the value also requires a knowledgeable attorney.

Sometimes, but the value of your claim is typically discounted by your percentage of fault.

Simply put, there are hard cases and there are easy cases to handle. Many lawyers just take easy cases but that’s not us!  We often decline smaller cases and do our best to send those to younger, less experienced attorneys.  Complex, large, serious injury cases are the firm’s focus for litigation.

Yes, often it is a two year limit but in some tricky situations it can be more or less than two years. The best thing to do is to talk to an attorney immediately, even if you do not immediately hire the attorney.

Our firm works on what is called a contingent fee basis. This means that our fee is a percentage of the recovery we obtain for our client. When we take on a case, our clients never have to pay us for expenses or fees, unless we obtain a recovery for them.
