Many workers don't know that they are entitled to overtime pay and other wages under the Fair Labor Standards Act (FLSA). Under the FSLA, most employees are divided into two groups; you are either "Exempt" or "Nonexempt".  A "Nonexempt" employee that works more than 40 hours during the workweek is generally entitled to overtime pay. Employee Earns Less than $23,660 per year: Those who earn less than $23,660 annually are almost always entitled to be paid overtime wages.

Non-management Employees: Generally, those who perform these type of job roles are entitled to overtime pay production, kitchen or restaurant, construction, maintenance or repair, installation, and clerical or secretarial workers.

Hourly Employee: Almost all hourly employees should be able to receive overtime pay. There are a few exceptions.

Commissioned Employees: Most employees who receive commissions are entitled to overtime pay, except for those who work outside the office or travel on a regular basis.

Salaried Employees: Even most salaried employees are entitled to receive overtime wages unless they fall under a specific exception. Those exceptions include:

  • the executive overtime exception
  • outside sales exceptions
  • certain computer-related employees
  • the managerial exception
  • and exceptions related to specific job industries
